CanvasFur Standard Terms of Service
These Terms set forth the general conditions for the engagement of artistic services between Artists and Clients using CanvasFur.
CanvasFur provides tools for artists to showcase their work, services, pricing, availability, and terms of engagement. Each Artist manages their own page and is responsible for the services they offer.
These are the CanvasFur Standard Terms of Service. Artists may supplement or replace them with their own Terms of Service.
Any specific conditions presented by the Artist must be made available to the Client prior to the confirmation of the engagement.
1. Relationship between Artist, Client, and CanvasFur
The engagement for a commission or other artistic service establishes a relationship between the Artist responsible for the service and the Client who commissioned it.
Unless a specific feature expressly indicates otherwise, CanvasFur does not determine:
- prices charged by the Artist;
- services offered;
- number of revisions;
- production timelines;
- payment methods;
- cancellation policies;
- commercial licenses;
- content the Artist agrees to produce;
- or other specific terms of the engagement.
Such information is defined by the Artist themselves.
CanvasFur also does not guarantee the acceptance of requests, the availability of a specific Artist, or the completion of an engagement entered into directly between users.
Any responsibilities incumbent upon CanvasFur by law or arising from services provided directly by the platform are not excluded by this section.
2. Conditions applicable to the engagement
Each engagement may consist of:
- these Standard Terms of Service;
- the Artist's own Terms of Service, if applicable;
- information presented on the service page;
- the approved quote;
- the brief provided by the Client;
- any additional licenses or conditions agreed upon; and
- specific agreements recorded in writing between the Artist and the Client.
A specific condition expressly agreed upon between the parties shall prevail over a general rule only regarding the specific point it modifies.
When the Artist has their own Terms of Service, these shall prevail over these standard Terms in the relationship between the Artist and the Client.
No particular condition may override the CanvasFur Terms of Use, mandatory platform rules, or rights that cannot be excluded under applicable law.
3. Order acceptance
Submitting an order does not oblige the Artist to accept it.
Prior to confirmation, the Artist may review the brief, request additional information, check their availability, provide a quote, or decline the service.
The engagement shall be considered confirmed once the conditions presented by the Artist are accepted by the Client and the confirmation requirements specified for that service—including any required payment—are met.
When the Artist establishes their own conditions regarding payment, deadlines, production, or service delivery, these must be presented prior to confirmation.
4. Brief and references
The Client must provide sufficient information for the Artist to understand the requested service.
This may include characters, visual references, poses, clothing, accessories, backgrounds, dimensions, formats, the intended use of the artwork, and other relevant characteristics.
The Client is responsible for:
- providing correct and understandable information;
- specifying mandatory characteristics that cannot be identified from the references;
- clarifying which reference takes precedence in the event of contradictions;
- informing the Artist in advance of the intended use of the work, especially regarding commercial use;
- and holding the necessary rights or authorizations for any materials provided to the Artist.
Information that is omitted, incorrect, or added at a later stage may necessitate changes to the scope, price, or deadline.
The Artist is not obliged to reproduce characteristics that were not disclosed or that cannot be reasonably identified from the provided material. ## 5. Fees and payment
The cost of the service must be stated or confirmed before production begins.
The Artist may determine their own payment methods, accepted currencies, installment plans, payment deadlines, and order confirmation requirements.
Production will only commence once the payment conditions established by the Artist have been met.
Changes in scope, additional characters, backgrounds, extra revisions, or other elements not included in the original quote may result in additional charges.
No charges resulting from an order modification shall be applied without the Client being informed of the change beforehand and given the opportunity to accept it.
6. Production and deadlines
The Artist is responsible for informing the Client, where applicable, of the key characteristics of their production process and the estimated timeframe for completing the service.
The process may be divided into stages, such as guide, sketch, line art, color, rendering, or other stages defined by the Artist.
When certain stages are subject to Client approval, the Artist must indicate which decisions are open for review at each stage.
Unless a fixed deadline has been expressly agreed upon, dates or timeframes presented as estimates may be subject to reasonable changes due to the complexity of the work, revisions, scope changes, or events affecting production.
The deadline may be paused while the Artist awaits information, references, approvals, or payments necessary to continue the service.
The existence of other orders in the queue or the simultaneous production of different works does not, in itself, constitute a failure to perform the service, provided that the agreed-upon conditions and deadlines are met.
7. Account security
The user is responsible for maintaining the security of the credentials used to access their account and must not share passwords or other authentication methods with third parties.
If the user identifies unauthorized access or any issue related to their account security, they must notify CanvasFur as soon as possible.
8. Platform availability
CanvasFur strives to keep its services available and secure but does not guarantee uninterrupted or error-free operation.
The platform may undergo maintenance, updates, modifications, or temporary interruptions when necessary for its operation, security, or development.
9. Account suspension and termination
CanvasFur may restrict, suspend, or terminate accounts used in violation of these Terms, particularly in cases involving fraud, infringement of third-party rights, abusive use of the platform, security risks, or illegal activities.
Whenever reasonably possible, such measures will be taken in a manner proportionate to the situation identified. Users may also request the closure of their own accounts using the mechanisms provided by the platform.
10. External links and services
User pages may contain links to social media networks, payment platforms, stores, commission services, or other external websites.
These services have their own terms and privacy policies. CanvasFur does not control and is not responsible for the operation, content, or data processing practices of external services accessed via these links.
11. Changes to these Terms
These Terms may be updated to reflect changes to the platform, its services, or applicable law.
When a change significantly affects users' rights or responsibilities, CanvasFur will endeavor to inform users appropriately before or at the time the change takes effect.
The most recent version of these Terms will always be available on the platform.
